DIVISION:Hearings and Tax Litigation Division,Administrative Hearings Section
GENERAL DESCRIPTION:
Join the Texas Comptrollers Administrative Hearings Section as a Tax Hearings Attorney! Our attorneys provide valuable and rewarding public service to the citizens and taxpayers of Texas. Our diverse workload involves a wide range of industries, tax types, and novel legal issues. Attorneys review disputed tax assessments and refund denials, and work with agency staff and taxpayers to amicably resolve most matters through negotiated settlements. For cases that do not settle, attorneys represent the Comptroller at the State Office of Administrative Hearings, resulting in a published Comptrollers Decision resolving the matter and serving as precedent for future cases. This position provides ample opportunities for attorneys to enhance their careers by further developing persuasive legal writing, oral advocacy, and customer service skills. Performs highly complex to advanced (senior-level) legal work. Works under limited to minimal supervision, with considerable latitude for the use of initiate and independent judgment.
SALARY RANGES:
Attorney III: $7,175 – $7,575
Attorney IV: $7,575 – $8,050
Qualifications: MINIMUM REQUIREMENTS:Graduation from an accredited law school with a LL.B. or J.D. degree.
One (1) to three (3) years experience as a practicing attorney (Attorney III), or three (3) or more years experience as a practicing attorney (Attorney IV).
PREFERRED: Commercial litigation experience Administrative hearings experience Business law experience Licensed and experience working as a certified public accountant (CPA) or other experience with state taxation
LICENSES OR CERTIFICATIONS:Must possess an active license in good standing to practice law in the State of Texas or able to immediately activate license through Texas State Bar upon request.
IN THIS ROLE YOU WILL: Review case files, including the audit package or non-audit worksheets and the taxpayers statement of grounds disputing the assessment or refund denial. Identify taxpayers contentions, and the relevant facts and records. Research case law and the Comptrollers tax system to evaluate the contentions and to obtain additional relevant information. Works with taxpayers, auditors, and other agency personnel to resolve hearings amicably through settlement agreements when possible. Prepare legal briefs and motions, including the position letter, response to reply, notice of hearing, SOAH motions and briefs, exceptions and replies, motions for rehea ing and replies. Review legal arguments and supporting documents submitted by a taxpayer to support their contentions. Coordinate insolvency reviews. Prepare record for written submission hearings at SOAH, and represent the agency in oral hearings at SOAH. Communicate with other agency divisions to address and resolve issues raised in administrative hearings. Prepare and deliver presentations to agency personnel and/or the public to educate them on taxability or procedural issues of tax administration. Recommend, analyze and/or draft legislation or administrative rules. Performs other related work as assigned.
