Department Overview:

The attorney in this role will provide legal support for the US Digital, Data, Payments, and Marketing teams within the bank.

The overall objective of the role is to provide legal support, advice, and guidance across a broad range of digital services, payment systems, and marketing campaigns and capabilities. This includes, but is not limited to, online and mobile banking platforms, data aggregation and sharing, payment systems (e.g., ACH, ATM, Zelle, and RTP), and social media.

•tBachelors degree required

•tJ.D. from an Accredited Law School required

•t10+ Years of related experience

•tPreferred: Strong knowledge of the E-SIGN Act, FCRA, EFTA, GLBA, FFIEC Guidance on Social Media, OCC Bulletin 2013-29 (Third-Party Relationships: Risk Management Guidance) and other areas of law related to banking/financial services operations and issues

•tStrong knowledge of at least one area of law relating to banking/financial services operations and issues

•tIntegrity and high moral standards

•tStrong negotiation and conflict resolution skills

•tStrong legal and analysis skills

•tDetail oriented

•tMust be able to apply legal knowledge to the business

Job Description:

•tThe Senior Counsel provides oversight, legal advice and support for day-to-day operations of US Digital, Data, Payments and Marketing teams

•tReviews, prepares, and advises on online and mobile banking terms of service, E-SIGN Act disclosures and consent, UX functionality, and electronic document delivery and retention processes

•tAdvises on payment systems’ rules and requirements

•tCoordinates advice and support not only within US Digital, Data, Payments and Marketing Legal Team, but also with product attorneys and corporate functional legal support (e.g., Strategic Sourcing and Human Resources)

•tWorks collaboratively with the business, legal, compliance and other functional colleagues in a fast-paced environment to proactively identify and manage legal, regulatory, reputational, and other risks

•tAids in the development of operational solutions to meet legal requirements

•tMaintains legal expertise and business knowledge in the evolving digital banking and payments landscape

•tDelivers difficult messages without jeopardizing client relationships

•tGives pragmatic legal opinions with rationale

•tResolves most issues without senior attorney intervention

•tDemonstrates highest professional ethical and behavioral standards and complies with all applicable Bar Rules and Codes of Professional Responsibility, and corporate ethical and behavioral standards

•tSupervises external counsel providing advice or other legal services to the Company

•tAssists in the management of expenditures for external counsel

•tServes in one or more permanent or ad hoc practice groups or cross-practice teams of attorneys and staff

•tMay manage paralegal and administrative staff, assigning responsibilities and evaluating results

•tProvides leadership, coaching, counseling and guidance to staff
